Arbitrator/Attorney/Expert /Consultant..........$775 per hour, plus expenses; Retainer $10,000 per appointing party/side

Conditions
(1) Retainers are due and payable immediately upon Mr. Schmidt’s selection as umpire, sole
arbitrator, or mediator; upon notice to the other side of his appointment as arbitrator; and upon his
engagement as attorney, expert, or consultant. All retainers are minimums and nonrefundable
but will be billed against and accounted for in the final statement.
(2) Statements for fees and expenses may be submitted on a monthly, quarterly, semiannual,
annual, or case completed basis. Payment of fees/expenses is expected within 30 days of statement date, and late payments are subject to interest. Advances may be required prior to hearings and also as a consequence of late payments. If a W9 or formal invoice is required, please email the necessary form to Mr. Schmidt.
(3) All payments should be wire transferred to account # xxxxxxxxxxxxxx of Daniel E. Schmidt, IV, at the
Carefree, AZ branch of JP Morgan Chase Bank, N.A., bank routing # xxxxxxxxxxxxx. [Details provided upon engagement.]
(4) 1099s should be made out to Daniel E. Schmidt, IV, and mailed to his AZ home/office address. Mr.
Schmidt’s Tax ID # is xxxxxxxxx. [Details provided upon engagement.]
(5) Fees may be increased approximately $25 effective the beginning of each calendar year for new
assignments undertaken during that new year, as well as for ongoing assignments; however, this increase has only been applied once since 2008.
(6) If reserved hearing/meeting dates are cancelled, postponed, or otherwise not used, a charge of eight
hours for each such unused hearing date will be added to the statement, unless other factors are considered after discussions with counsel or unless another matter can be scheduled for any unused dates.
(7) Appointment/selection constitutes acceptance of these conditions.
